Complete Creative Constructions Terms and Conditions

1. Introduction

Welcome to Complete Creative Constructions (“we”, “us”, “our”). By engaging our services or using our website, you agree to these Terms and Conditions and warrant that you are over 18 years of age (or have appropriate consent) and have capacity to enter into and comply with these Terms.

2. Relationship to Manufacturer

2.1 We are an independent, authorised reseller and installer of premium fibreglass swimming pools manufactured by Pool Manufacturing Australia Pty Ltd (PMA). We do not manufacture pool shells.

2.2 Manufacturer warranties (pool shells). All structural designs for fibreglass swimming pool shells and all structural shell warranties are provided and backed by PMA as the manufacturer.

2.3 Our workmanship warranty (installation). We provide a separate workmanship warranty covering our installation services only (scope and duration as stated in your proposal/contract).

2.4 Other components. Equipment and accessories (e.g., pumps, filters, heaters, covers) are supplied with the respective original manufacturers’ warranties, which apply in addition to any rights under the Australian Consumer Law (ACL).

3. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the ACL.

4. Product Information

While we aim for accuracy, dimensions, specifications, colours, finishes, availability, and lead times may vary. Please verify critical details before purchase and installation.

5. Quotations, Pricing, and Payments

5.1 Quotes are valid for the period stated and may be subject to site conditions, approvals, or supplier price changes.

5.2 Progress payments are due upon reaching agreed milestones as set out in your contract or invoice.

5.3 Late payments may incur reasonable administration and interest charges.

6. Site Conditions, Approvals, and Variations

6.1 You are responsible for providing accurate site information and reasonable site access.

6.2 Council/authority approvals (where required) are your responsibility unless otherwise agreed in writing.

6.3 Unforeseen conditions or client-requested changes may require variations, which will be priced and approved in writing before we proceed.

7. Delivery, Risk, and Title

7.1 Risk in goods passes on delivery to site or on installation (as applicable).

7.2 Title passes on receipt of full payment.

8. Installation and Client Responsibilities

8.1 We will perform installation with due care and skill and in accordance with applicable standards.

8.2 You must follow all pre-installation and post-installation instructions, including curing times, water chemistry, and maintenance schedules, to avoid damage and to preserve warranty coverage.

9. Warranties and Claims Process

9.1 Shell warranty (PMA). Claims relating to the structural shell must be made under the PMA manufacturer warranty. We will reasonably assist you to lodge a claim with PMA, but assessment and remedy are determined by PMA under its warranty terms.
